The African Commission on Human and Peoples' Rights, established in , was the third regional instrument, after the European and American systems, for the promotion and protection of human rights. This book, drawing on the jurisprudence and practice of the Commission, challenges the applicability of international law to the African situation. Following an examination of the evolution of the African Charter and the status of ratification, Murray questions the opposing dichotomy approach of international law. Her critical analysis covers the notion of the state, the issue of personality and the application of the international law distinctions between war and peace and judicial and amicable disputes. The experience and approach of the African Commission is compared with that of other regional and international bodies, leading to the conclusion that a more holistic approach to international law is required if human rights are to be adequately protected.
Under Articles 55 and 56 of the African Charter on Human and Peoples' Rights, everyone can submit information or communications to the African Commission. By submitting a communication to the African Commission, victims of human rights abuses who for one reason or another could not obtain justice in their countries after exhausting all the available legal remedies may obtain help. A case that has been submitted to the African Commission should not at the same time be submitted to another international human rights system. Before a decision on the merits of the complaint, the African Commission may request from the State concerned to take provisional measures to prevent irreparable harm to the victim or victims of the alleged violation as urgently as the situation demands. After investigating a complaint, the African Commission makes a recommendation to the State s concerned, to ensure that the occurrences of human rights violations are investigated, that the victim s is compensated if necessary and that measures are taken to prevent the recurrence of human rights violations.

The first section provides context about the ACHPR and its mandate as a human rights mechanism on the African continent.
The function of the African Commission will be outlined as well as the roles and relationship between the institutions that aid in the implementation of the Charter. An example of this inadequacy is the lack of explicit recognition of the right to privacy and the right against forced or compulsory labour. Furthermore, Article 7 and Article 13 concerning the right to a fair trial  and the right to political participation  are considered to be incomplete compared to international standards. These articles are ineffective and fail to accomplish their aim.
Under the ACHPR, states are required to submit reports to the African Commission on measures taken to ensure that the rights enshrined in the African Charter are being implemented. The state reporting procedure is considered as a dialogue, in which the state concerned and the African Commission exchange their views. The state report is published by the African Commission prior to the session, to give civil society the opportunity to comment on the report of the state. So far, conscientious objection to military service has not been addressed by the African Commission.
The African Commission on Human and Peoples' Rights ACHPR is a quasi-judicial body tasked with promoting and protecting human rights and collective peoples' rights throughout the African continent as well as interpreting the African Charter on Human and Peoples' Rights and considering individual complaints of violations of the Charter. This includes investigating human rights violations, creating and approving programs of action towards encouraging human rights, and set up effect communication between them and states to get first hand information on violations of human rights. This ends up in them drafting up proposals to send up the chain of command to the Assembly of Heads of State and Government and they will act accordingly. The charter has twenty-nine articles that go into great detail on the rights and freedoms that follow a strict code of non-discrimination.

Though Cameroon , Niger and Malawi were initially scheduled to be reviewed during the 66th session, only Mauritius was reviewed in the end. The Commission held a special session on the major human rights issues arising in the context of COVID and measures undertaken by the Commission in response.
