While the law raises the minimum marriage age to 18—a positive move to combat child marriage—it also promotes a policy of exclusion against LGBTI Malawians that would likely translate into discrimination in education, housing, jobs and elsewhere. The law is expected to go into effect today, having been signed by the president on Wednesday, before he traveled to the United States for meetings. The law denies equal rights to form a family to transgender, intersex and other individuals whose identity does not align with that assigned at birth, and ignores the reality of any co-living arrangement not in the form of opposite-sex couples—including non-romantic relationships. The United Nations in Malawi has praised the bill for requiring 18 as a minimum age for marriage in a country that ranks 8th globally for high rates of child marriage, but has failed to publicly raise concern over its discriminatory provisions. Child marriage occurs when one of the parties is below the age of 18 years. In Zimbabwe, South Africa and Malawi research has shown that most child marriages are linked to harmful practices that are embedded in culture. Law reform to end child marriage, therefore, is a difficult task since it presents a potential conflict between children's rights and cultural rights. This article critically examines how these selected countries seek to address the conflict between cultural practices that lead to child marriage and the protection of children's rights. It also highlights conceptual as well as practical difficulties that law reformers face in regulating cultural practices, and the gaps in the reforms that need to be addressed.
